1. About this statement
This statement explains how EngSiteTools ("we", "us", "our") collects, uses, stores and shares personal information when you enquire about or use our earthworks haulage visualisation service (the "Service"). It adds to our general EngSiteTools Privacy Policy, which covers this website, our contact form and emails you send us. We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).
How we protect your confidential business information, such as your methodology, haulage spreadsheet and tender details, is set out in the terms we send with your quote.
2. Information we collect
- Contact details: your name, email address, phone number, company and role, if you provide them.
- Enquiry details: what you tell us through our contact form or by email, such as the type of works, location, timing and preferred length.
- Project materials: methodologies, haulage spreadsheets, drawings, programs, site photos, logos and your feedback on drafts. These are mostly business information, but they can contain personal information, for example the names, signatures and contact details of staff or subcontractors, or images of people in site photos.
- Billing and payment details: business name, ABN, billing contact, and the payment details that appear in our bank records (such as the payer name and reference). If a card payment option is offered, the card is processed by a third-party payment provider and we don't receive or store your full card number.
- Communications: emails and messages you send us.
3. How we collect it
We collect personal information directly from you or your colleagues, through our contact form, by email and in the files you send us. If you give us information about other people (such as staff named in a methodology), please make sure you're allowed to share it and that they know you're sharing it with us.
4. How we use it
We use personal information to:
- respond to your enquiry and prepare a quote;
- produce your visualisation, and communicate with you about drafts, revisions and delivery;
- issue invoices, receive payments and keep business and tax records; and
- comply with our legal obligations.
We don't sell or rent personal information, and we don't use it for unrelated marketing.
5. Please send only what we need
Before you send project materials, please remove personal information we don't need to produce the visualisation, such as phone numbers, email addresses and signatures in your methodology.
Our visualisations use generic, representative people. We don't model real, identifiable people from your photos unless you specifically ask us to and confirm you have their consent.
6. Who we share it with
We only share personal information as needed to provide the Service, with:
- service providers that help us run the Service, such as email, website hosting (Cloudflare, which also delivers contact form messages), cloud storage and file transfer, production and rendering software, and accounting and payment providers;
- professional advisers, such as our accountant or lawyer, where needed; and
- anyone we are required or authorised by law to share it with.
7. Overseas disclosure
Some of our service providers may store or process information outside Australia, including in the United States.
8. Storage and security
We store information in password-protected accounts and cloud services, and limit access to the people working on your project. No method of storage or transmission is completely secure, but we take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access.
9. How long we keep it
- Enquiries and correspondence: kept for as long as we need to deal with your enquiry, then deleted within 24 months, in line with our general Privacy Policy.
- Project materials and working files: deleted within 12 months after final delivery or, if the project doesn't go ahead, within 12 months after your enquiry closes. You can ask us to delete them sooner.
- Invoices and payment records: kept for at least 5 years, as required by Australian tax law.
If you ask us to delete information early, we will, unless we need to keep it for a legal reason or an unresolved dispute.
10. Access and correction
You can ask to access or correct the personal information we hold about you by emailing support@engsitetools.com. We'll respond within 30 days, and may need to verify your identity first. If you're outside Australia, you may have additional rights under your local law; see our EngSiteTools Privacy Policy for details.
11. Complaints
If you have a concern about how we've handled your personal information, please contact us first, and we'll respond within 30 days. If you're not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
12. Changes to this statement
We may update this statement from time to time. When we do, we'll publish the new version on this page with a new effective date.
